Article 1 – Legal notices

Article 2 – General provisions relating to these general conditions of sale (hereinafter, the “CGV”)

2.1. Purpose of the General Terms and Conditions
The General Terms and Conditions apply exclusively to the online sale of the Company's products on the Site, access to which is open and free to any Internet user.

2.2. Scope of application of the General Conditions of Sale
The General Terms and Conditions exclusively govern contracts for the online sale of the Company's products to buyers having the status of consumers (hereinafter, the "Consumers") and constitute with the order form the contractual documents enforceable against the parties, with the exclusion of any other documents, prospectuses, catalogs or photographs of the products which have only indicative value.

2.3. Availability and opposability of the General Conditions of Sale
The General Terms and Conditions are made available to Consumers on the Site where they can be directly consulted.

Validation of the order by its confirmation constitutes acceptance by the Consumer of the General Terms and Conditions in force on the day of the order, the conservation and reproduction of which are ensured by the Company in accordance with article 1369‐4 of the Civil Code.

2.4. Modification of the T&Cs
The Company reserves the right to modify its General Terms and Conditions at any time.
In the event of modification, the applicable General Terms and Conditions are those in force on the date of the order.

2.5. Clauses of the General Conditions of Sale
The nullity of a contractual clause does not result in the nullity of the General Terms and Conditions.
The temporary or permanent non-application of one or more clauses of the General Conditions of Sale by the Company cannot constitute a waiver on its part of the other clauses of the General Conditions of Sale which continue to have their effects.

Article 3 – Price

The sales prices are indicated, for each of the Products, in euros, all taxes included, excluding any delivery and transport costs, mentioned before validation of the order and invoiced additionally.

The total amount owed by the Consumer is indicated on the order confirmation page. The selling price of the Product is that in effect on the day of the order.

The Company reserves the right to modify its prices at any time, while guaranteeing the Consumer the application of the price in force on the day of the order.

Article 4 - Offer

The online sales offers presented on the Site are valid, in the absence of indication of a particular duration, as long as the Products appear in the electronic catalog and within the limit of available stocks.

Acceptance of the offer by the Consumer is validated, in accordance with the double click process, by confirmation of the order.

Article 5 – Order

5.1. Stages of concluding the contract
To place an order, the Consumer, after having filled his virtual basket by indicating the selected Products and the desired quantities, then clicks on the “Checkout” button and provides information relating to delivery and payment method.

Before clicking on the “Pay” button, the Consumer has the possibility to check the details of his order and its total price and to return to previous pages to correct any errors or possibly modify his order.

An email acknowledging receipt of the order and its payment is sent by the Company to the Consumer as soon as possible.

5.2. Confirmation of the order
The Company reserves the right to refuse any order for legitimate reasons and, more particularly, if the quantities of Products ordered are abnormally high for buyers who are consumers.

5.3. Unavailability of ordered Products
If the Products ordered are unavailable for delivery, the Company immediately informs the Consumer and can offer them a Product of equivalent quality and price. In the event of disagreement, the Consumer is reimbursed no later than thirty days following the order.

Article 6 – Right of withdrawal

The Consumer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal, without having to justify themselves or pay a penalty.

The Consumer must inform the Company of his decision to withdraw, by sending an unambiguous email to contact@maisonzouzou.fr

Return costs are the responsibility of the Consumer.

The Company undertakes to reimburse the Consumer for all amounts paid, including delivery costs, at the latest within fourteen (14) days following receipt of the returned Product.

The Company makes the reimbursement using the same means of payment as that used by the Consumer for the initial transaction, unless the Consumer expressly agrees to use another means of payment and to the extent that the reimbursement does not cause costs for the Consumer.

The Company is not required to reimburse additional costs if the Consumer has expressly chosen a more expensive delivery method than the standard delivery method offered by the Company.

However, in application of article L.121-21-8, 3°, of the Consumer Code, in the case of a Product made by the company according to the specifications of the Consumer or personalized at the Consumer's request, the The purchase is firm and final and the consumer expressly waives his right of withdrawal.

Article 7 – Payment

The price is due in full after confirmation of the order.

Payment is made immediately upon ordering by credit card or Paypal account.

Article 8 – Delivery

8.1. Delivery delay
To the extent that each Product is manufactured in an artisanal manner and made to order, the Company undertakes, in accordance with the deadlines indicated on the Site, to ship the Products within 7 to 10 days from the order.

Delivery times are 3 working days for orders placed in France, 5 working days for orders placed in the European Union and 10 working days for orders placed outside the European Union.

8.2. Delivery terms
The Products are delivered to the address indicated by the Consumer at the time of the order.
Any complaint of delivery error must be made by the Consumer to Customer Service on the same day of delivery or the first working day following delivery at the latest.

Delivery is made by Lettre Suivi or Colissimo Suivi. The Company reserves the most suitable delivery method if necessary.

8.3. Risk of loss or damage
Any risk of loss or damage to the Products is transferred to the Consumer at the moment when the latter or a third party designated by him, and other than the carrier proposed by the Company, takes physical possession of these goods.

In the event of non-delivery of the Product, the Consumer may ask the Company to reship the Product ordered or to obtain a refund, provided that the Consumer provides proof that he never received the Product. Product, in particular by addressing any complaints to the carrier.

When the Consumer entrusts delivery of the Product to a carrier other than that offered by the Company, the risk of loss or damage to the goods is transferred to the Consumer upon delivery of the Product to the carrier.

Article 9 – Legal guarantees

All Products benefit from the legal guarantee of conformity provided for in Articles L. 211‐4 to L. 211‐14 of the Consumer Code and the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the Civil Code.

Under these guarantees, the Company undertakes to exchange Products that are defective or do not correspond to the order.

If the Company is unable to replace the non-compliant Product, it will provide a refund.

Article 10 – Liability

The Company cannot be held liable in the event of non-performance or poor performance of the contract due either to the Consumer, to the insurmountable and unforeseeable act of a third party to the contract, or to force majeure.

Article 11 – Intellectual property of the elements of the Site

The elements reproduced on the Site, in particular, and without this list being exhaustive, the photographs, visuals, texts, drawings, images, brands, graphics, animation, information, data (hereinafter the “Elements”) which are the exclusive property of the Company, are protected by copyright and trademark law.
Any reproduction and distribution of the Elements, without prior written authorization from the Company, exposes offenders to legal proceedings.

Article 12 – Applicable law, disputes and complaints

This contract and the T&Cs governing it are subject to French law. The General Terms and Conditions are drawn up, as well as all contractual information mentioned on the Site, in French. Any complaints must be addressed to Customer Service. In the event of a dispute, the parties may resort to a conventional mediation procedure or any other alternative method of dispute resolution.
